USE OF LATIN NCAP WEBSITE
Last updated: October 1, 2026
Welcome to Latin NCAP’s website (the "Site"). These Terms and Conditions ("General Conditions") govern access to and use of the Site and the content and services available through it. They apply to all visitors and individuals who access the Site ("Users").
EACH USER MUST CAREFULLY READ THESE GENERAL CONDITIONS, AS THEY CONTAIN IMPORTANT INFORMATION REGARDING THE LEGAL RIGHTS AND OBLIGATIONS OF LATIN NCAP AND THE USERS. ACCESSING AND/OR USING THE SITE IMPLIES THAT THE USER HAS READ, UNDERSTANDS, AND AGREES TO BE BOUND BY THESE GENERAL CONDITIONS.
These General Conditions must be read in conjunction with the Latin NCAP Privacy Policy, the provisions of which are deemed incorporated by reference.
1. Acceptance of Terms
Accessing and/or browsing the Site constitutes the User’s acknowledgment and full acceptance of these General Conditions. Any User who does not accept them, disagrees with them, or fails to comply with the provisions set forth herein is not authorized to use the Site and must refrain from accessing and/or using it.
2. Access to the Site
Access to the Site and the content available therein is open and free of charge, and is not subject to the payment of any fee or remuneration to Latin NCAP. This free access does not include Internet connectivity; the provision of such connectivity is the sole responsibility and expense of each User.
Latin NCAP reserves the right to modify, suspend, or discontinue access to the Site or any part of its content—whether temporarily or permanently—without prior notice or any right to compensation for Users.
3. Purpose of the content and test results
The content of the Site, particularly the vehicle safety test results published by Latin NCAP, is for informational purposes only. Latin NCAP makes its best efforts to keep such information up-to-date and accurate but does not guarantee its accuracy, completeness, or continued currency.
The vehicles tested may differ—in terms of their specific version and safety equipment—from those actually sold in the various markets across the region; therefore, the published results cannot necessarily be extrapolated to every unit offered for sale under the same model name. Latin NCAP assumes no responsibility for any damages of any kind that may arise from the use of this information, or from reliance placed upon it when making purchasing or other types of decisions.
4. Intellectual property
All content on the Site (including, for example, text, photographs, graphics, images, videos, test results, technology, software, source code, graphic design, brands, and other distinctive signs) is the property of Latin NCAP or of third parties who have authorized its use, and is protected by applicable intellectual and industrial property laws.
Any reproduction, distribution, public communication, or editing—whether in whole or in part—for commercial or advertising purposes is prohibited, as is any use not expressly authorized by Latin NCAP. The User does not acquire any rights to such content merely by accessing or using the Site.
5. Links to third-party sites
The Site may contain links to third-party websites (including, but not limited to, those of Global NCAP, vehicle manufacturers, or affiliated organizations). Such links are provided for informational purposes only. Latin NCAP does not control, nor is it responsible for, the content, availability, or privacy policies of the third-party sites that may be accessed via these links.
6. Contact form, personal data, and informed consent
The Site provides a contact form that Users may use to submit their name, email address, and any other information they choose to include in their inquiry. Such data is used exclusively for the purpose of managing and responding to the inquiry and is not subsequently stored by Latin NCAP.
By completing and submitting the contact form, the User acknowledges and accepts this clause and provides their free, prior, express, and informed consent for the processing of their personal data for the purpose described above, in accordance with Article 9 of Law No. 18.331 on the Protection of Personal Data. Given that this data is not stored, the exercise of rights of access, rectification, or erasure is not applicable, as no such record exists; nevertheless, the User may contact Latin NCAP regarding any inquiries related to the processing of their data, using the contact channels specified in these General Terms and Conditions.
7. Cookies and analytics tools
The Site uses cookies and other third-party analytics tools, including Google Analytics and Meta, to understand user browsing behavior and compile statistics on Site usage. Upon accessing the Site, a consent notice will be displayed, allowing the User to accept, reject, or configure the use of cookies before continuing to browse.
Users may also configure their browser to block, restrict, or delete cookies, though doing so may affect the proper functioning of certain sections or features of the Site. For further information, please refer to the Latin NCAP Privacy Policy.
8. International data transfer
In the event that personal data collected through the Site—including data collected via the cookies and analytics tools mentioned in the preceding clause—are processed by service providers located outside the territory of the Oriental Republic of Uruguay, the User gives their express and unequivocal consent to such international data transfer, under the terms and with the safeguards provided for in Article 23 of Personal Data Protection Law No. 18.331 and its Regulatory Decree No. 414/009.
9. Limitation of liability
Latin NCAP shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Site, nor for any failures, interruptions, or disconnections originating from telecommunications networks or from causes beyond its control. It is the User’s responsibility to have appropriate tools in place to protect their equipment against viruses or other harmful computer elements.
10. Modifications to the Terms
Latin NCAP may modify these General Conditions at any time without prior notice. Modifications shall take effect upon their publication on the Site, with the date of the last update indicated in the header. Users are advised to review these Conditions periodically.
11. Governing law and jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Oriental Republic of Uruguay, with the ordinary courts having jurisdiction in the City of Montevideo being the competent authority.
